Executive Director – Kate Clark

Kate has over 25 years’ experience in litigation support, including 7 years at Mallesons Stephen Jaques (now King & Wood Mallesons) and many years in management roles in eDiscovery providers and mid-tier law firms.

Kate brings strong project management skills and a unique understanding of clients, commercial imperatives, technical discovery issues and project management to the team. Kate has an extensive knowledge of legal processes and procedures and an ability to communicate effectively with the client, the client’s inhouse IT department, the law firm and the electronic discovery provider.

Kate is focussed on using technology to reduce the time and cost spent on document management and legal review. Kate works closely with:

  • client teams to ensure that she understands their document management systems and how to quickly and effectively retrieve documents from those systems;
  • the legal team to understand the issues in the dispute so that she can effectively manage the electronic discovery process and assist the team in retrieving and reviewing data quickly; and
  • external eDiscovery providers to structure the litigation databases to assist the legal team in managing the documents.

Kate has managed teams of lawyers, paralegals and electronic discovery providers on many projects to maximise the value of the services provided to clients.

Executive Chair – Bill Ash

As a senior corporate lawyer and executive with EXXON, ARCO and Wesfarmers, Bill project managed significant litigation matters. Bill is acutely aware of the need to minimise costs, time and frustration and maximise outcomes by intelligent project management of eDiscovery; enabling his legal and executive teams to do their day-to-day tasks of creating value for shareholders, not being unnecessarily distracted by the demands of discovery.

Before moving in-house, Bill worked in the laws firms Allens (Sydney), Shearman & Sterling (New York) and Deacons/Linklaters (Hong Kong). Bill also ran his sole legal practice for 8 years, with clients including BP, Energy Developments, Wesfarmers and Enertrade.

In 2016 Bill moved on from Wesfarmers Resources and the practice of law to establish ARC Coaching, Mentoring & Facilitation. This allows Bill to follow his passion of using conversations to generate possibilities.

Non-Executive Director – Heidi Schweikert 

Heidi is a Director of ELMS and one of its founding clients, Schweikert Harris.

Heidi’s particular interest and expertise is in project managing significant engineering and construction, commercial and resources dispute resolution. Heidi has acted for some of Australia’s leading corporate organisations in major disputes in the Supreme Courts of Queensland and New South Wales and advised clients engaging in less formal dispute resolution processes in those states and Victoria.  Heidi has project managed teams of up to 40 lawyers and paralegals in resources and construction disputes including large and complex claims with significant amounts at stake (around $700 million).

Heidi’s experience has emphasised to her the importance of intelligent document investigation and management to minimise cost to the client and maximise both the value of the document retrieval and review process. This allows the lawyers to get to the know case as early as possible, enabling the lawyers to allow focus on substantive issues and strategy – not leaving this until after expensive review of millions of documents.  Heidi brings this experience to the ELMS board table, adding significant value to our business.

Non-Executive Director – Andrew Harris

Andrew is a Director of ELMS and Schweikert Harris (where he specialises in construction, engineering and commercial litigation). 

Andrew has substantial experience in advising principals and contractors in the construction and engineering sectors, as well as advising insurers and corporations in respect of insurance claims.  Andrew’s experience and understanding of discovery issues (particularly in complex disputes) and the importance for clients of managing discovery in a way that is efficient and cost effective, enables him to provide valuable insight for ELMS on its services and the best options for meeting client needs.
